1. About the service

JustSell is an online platform for selling second-hand items quickly and easily. Take a few photos with your phone and our AI takes care of the rest — it identifies the brand, model and condition, estimates a market price, writes an attractive description in multiple languages, and prepares your listing for publication.

You don't need to write anything — you snap, we describe.

Visitors may try the AI-powered listing generation without creating an account at /try — see section 5a for the rules and limits that apply to this trial mode.

2. Registration and account

  • You must be at least 18 years old to use the platform.
  • You are responsible for the security of your account and all actions taken with it.
  • One account per person or legal entity. Shared or automated accounts (bots) are not permitted.
  • You must provide a valid email address and accurate information. False details will result in account suspension.

Minors: If we become aware that an account belongs to a person under 18, we will immediately suspend the account and delete all associated personal data, unless a parent or legal guardian provides verifiable consent within 14 days, in which case the account is permanently deleted regardless. We do not knowingly process data of minors and do not direct the service at minors.

3. What we do with your photos and data

When you upload photos, they are:

  • Automatically analysed using AI models provided by a third-party service, to identify the product, condition, brand and model.
  • Screened for prohibited content — our AI automatically checks every upload for illegal items, explicit content, weapons, and personal photos not suitable for listings (see section 4). Uploads that fail this check are rejected and the images are permanently deleted.
  • Visually processed — we improve brightness, contrast and cropping to make your item more attractive.
  • Stored securely on certified servers (Hetzner Object Storage, S3-compatible).
  • Used exclusively to create your listing. We do not sell your photos and we do not use them to train AI models.

AI-generated descriptions are suggestions — you can edit them before publishing.

4. Prohibited content

The following is strictly forbidden:

  • Weapons, ammunition, explosives, hazardous substances
  • Drugs, psychotropic substances, or products mimicking their effects
  • Counterfeit goods, unauthorised copies, or illegally obtained items
  • Live animals (except where explicitly permitted by law)
  • Sexually explicit content
  • Stolen goods or items obtained through fraud
  • Prescription medicines or medical devices without authorisation
  • Any product whose sale is prohibited by law in Romania or the EU

We reserve the right to remove any listing that violates these rules and to suspend or close the responsible account without prior notice.

Automated content screening: Both uploaded images and submitted text (listing titles, descriptions, hints, keywords, and messages between users) are screened automatically by AI before any human review. The same screening applies to trial uploads (see section 5a) — trial uploads that fail screening are deleted; because trial users do not have an account, no moderation incident is recorded against any user identity.

  • Images: rejected if they show prohibited items, explicit content, weapons, identity documents, or real human faces as the primary subject. Rejected images are permanently deleted.
  • Text: rejected if it contains HTML markup, explicit/pornographic language, hate speech, threats, harassment, or promotional spam (including off-platform contact details embedded in listing fields).

Each rejection is recorded as a moderation incident linked to your account (see section 10 on automated suspension). You are shown the reason for each rejection. If you believe a rejection was made in error you may appeal by emailing suport@justsell.ro within 14 days with a description of the content and the reason you believe the rejection was incorrect.

5. Listing rules

Seller profile required to publish. Before any listing can be published, the seller must complete the seller profile in Account Settings with:

  • A location (at minimum: country and region/county); city, street address and GPS coordinates may optionally be added — only country/region/city are displayed publicly, address and GPS remain private.
  • At least one public contact method (phone, email, or Facebook page) that the seller agrees to display on every published listing.
  • Explicit consent (a single tick covering both location and contact) for this information to appear publicly. The consent is recorded with a timestamp.

Subsequently editing the profile to remove the public location or all public contact methods will prevent publishing further listings until the profile is completed again. Existing published listings are not retroactively unpublished by such edits — the seller may unpublish or delete them manually.

Content rules for every listing:

  • You own the item you are selling or have the legal right to sell it.
  • The price is genuine — fictitious, artificially inflated prices or "call for price" tricks are not allowed.
  • Photos are real — you may not use images from the internet or photos of a different product.
  • One item = one listing — do not post the same item multiple times. If the AI mistakenly split photos of one item into separate listings, you may merge them via the "Merge with another listing" action; the secondary listing(s) and any related messages are then permanently deleted, and the merged listing is reverted to draft status for your review.
  • Descriptions are accurate — any defect or problem with the item must be mentioned.
  • Location is honest — the country, region and city you declare on your profile must match where the item is actually located, since these are shown publicly to buyers.

5a. Trial mode (try without an account)

You may try our AI-powered listing generation without registering by visiting /try and uploading photos of an item. The result page shows the AI-generated listing and offers to save it to a new account.

Trial use is governed by the same rules as registered use, with the following specific limits and conditions:

  • Same content rules apply — uploaded photos are subject to the same automated screening described in section 4. Prohibited content is rejected and the trial listing is deleted.
  • One trial per browser session and a per-IP-address rate limit (currently 3 trial uploads per IP every 24 hours) to prevent abuse. Excess attempts are blocked until the window resets.
  • Trial listings cannot be published, edited, or used for messaging. They exist solely to demonstrate the AI output.
  • Automatic deletion after 7 days if no account is created — see the privacy policy for the full data-retention rules.
  • Adoption on signup: if the visitor creates an account (or signs in to an existing one) within the 7-day window, the trial listing is moved into that account as a normal draft, ready for review and publishing once the seller profile is complete.

Trial users do not have a seller profile and therefore cannot publish; once they register and complete a seller profile, the standard rules in section 5 apply.

5b. Publishing review

Every listing goes through an automated content review before it appears on the public marketplace. The review runs at most one minute after you submit the listing or save an edit.

  • Approved: the listing becomes published and you receive an email confirming it is live.
  • Rejected: the listing's status becomes rejected; we send you an email explaining why. You may edit and the next save resubmits the listing automatically (subject to the credit rules in section 6.1).

Editing an approved listing — we treat any change to a published listing as a content change that must be reviewed again. After saving an edit, the listing leaves the public marketplace and re-enters review until approved.

The first two re-publications after the initial publish are free (covered by the original credit). From the third re-publication onwards, each one costs 1 additional credit — see section 6.1 for details.

5c. Importing listings from third-party sources

We provide a tool that imports your existing listings from third-party platforms (e.g. OLX.ro) into your account, where the AI then re-writes the descriptions in your preferred style. Use of this tool is subject to the following conditions, all of which you accept by triggering an import:

  • Ownership and rights are your sole responsibility. You declare and warrant that (a) the source account you point us at is yours, (b) the listings you choose to import — including all text, photographs, attributes and prices — are your own original content or content you are otherwise legally entitled to reproduce, and (c) nothing you import infringes the intellectual-property rights, trademarks, privacy rights or any other rights of any third party (including the source platform, other sellers, manufacturers, photographers or models).
  • Confirmation at import time. Each import requires you to tick a confirmation box stating the above. We log the timestamp, source URL and identifiers of every imported listing so that the declaration is auditable.
  • You remain the publisher. Imported items land as drafts; you review and publish them. Once published, all rules in sections 4 and 5 apply identically — being imported does not exempt a listing from any content rule, and any subsequent moderation incident is attributed to your account.
  • You indemnify us against any third-party claim (including from the source platform or from rights holders) arising from content you imported in breach of the warranty above. This includes, without limitation, claims based on copyright, trademark, database rights, terms-of-service breach, or unfair competition.
  • Source-platform terms still bind you. Importing through this tool does not override or replace any obligation you owe the source platform under its own terms of service. It is your responsibility to verify that running an import is compatible with those terms.
  • Best-effort retrieval. The import tool reads the publicly visible content of your listings on the source platform. We do not guarantee accuracy, completeness or availability of the import — third-party sites change without notice and an import may partially or wholly fail. No credit is consumed for items that fail to be created; credits already spent on items that fail later in the AI analysis follow the standard credit rules in section 6.
  • Removal on request. If a rights holder credibly notifies us that imported content infringes their rights, we may remove the affected listings without prior notice and request from you proof of ownership; repeated infringement leads to account suspension under section 10.

6. Prepaid credits and payments

6.1 The credit system

The platform operates on a prepaid credit system. Each listing you create — regardless of whether it is published — consumes 1 credit.

The credit you spend at creation covers:

  • The initial AI analysis (title, description, price estimate, etc.);
  • The first publication, after our automated content review;
  • Two free re-publications after edits — every edit to a published listing automatically resubmits it for review (see section 5b).

From the third re-publication onwards, each subsequent re-publication costs 1 additional credit. If you don't have enough credits at the moment of re-submission, you'll be redirected to the credit page; your edits are not saved until the credit is available.

6.2 Free credits at registration

Upon account creation, each user receives a number of free credits determined by their position in the registration order, as follows:

  • First 100 registered users: 50 free credits
  • Users at positions 101 to 350: 20 free credits
  • Users at positions 351 to 1,000: 10 free credits
  • All users registered after position 1,000: 3 free credits

The number of free credits is determined automatically and irrevocably at the time of account creation, based on the total number of accounts existing at that moment. JustSell accepts no liability for discrepancies arising from simultaneous registrations or other technical circumstances. The free credit allocation is final and cannot be disputed.

6.3 Purchasing additional credits

Once your free credits are exhausted, you may purchase additional credits via the Credits page in your account. Credits are sold in predefined packages whose prices are displayed at the time of purchase and may be changed at any time without prior notice. The applicable price is the one shown at the time of payment.

6.4 Credit characteristics

  • No expiry — purchased credits do not expire and remain in your account indefinitely.
  • Non-transferable — credits are tied to your personal account and cannot be transferred to another user.
  • Non-combinable — credits cannot be combined with other offers unless explicitly stated.

6.5 Refund policy

Purchased credits are non-refundable, except where required by applicable consumer protection law. By completing a purchase you acknowledge that the digital service has been delivered immediately and you waive the right of withdrawal under Directive 2011/83/EU to the extent permitted by law. Free credits have no monetary value and cannot be refunded under any circumstances.

6.6 Payment processing

Payments are processed by Stripe, a PCI DSS-compliant payment service provider. JustSell does not store your card details. By making a payment you also agree to Stripe's Terms of Service.

6.7 Billing errors

If you believe you have been charged in error, you must contact us within 30 days of the transaction date at suport@justsell.ro. Requests received after this period cannot be considered.

6a. Offers and messaging

Buyers may send messages and submit price offers to sellers directly through the platform. Submitting an offer does not constitute a legally binding contract — no sale is concluded until the buyer and seller agree on terms outside the platform and exchange payment and goods. JustSell is not party to any such agreement and assumes no liability for its execution.

Messages and offers are stored for the duration of the account. Both parties may access their message history. JustSell may access message content for the purpose of investigating abuse reports or legal obligations.

6b. Commercial sellers

If you mark a listing as sold by a company (including sole traders and freelancers acting in a commercial capacity), you acknowledge that you are transacting as a professional seller and that your buyers are entitled to the rights provided by applicable consumer protection law, including but not limited to:

  • A 14-day right of withdrawal (cooling-off period) for distance sales under Directive 2011/83/EU and Romanian Law 449/2003.
  • Statutory legal guarantee of conformity (minimum 2 years under EU Directive 2019/771).
  • Accurate display of VAT-inclusive prices where required by law.

JustSell provides VAT calculation tools as a convenience but does not verify the accuracy of VAT rates you enter and is not responsible for your tax compliance. You are solely responsible for meeting your fiscal and legal obligations as a commercial seller.

7. Liability and limitations

JustSell is an intermediary platform. We are not party to transactions between sellers and buyers, and we do not guarantee:

  • Completion of sales
  • 100% accuracy of AI-generated descriptions (always review before publishing)
  • Uninterrupted availability of the service (planned maintenance may occur)

The platform is not liable for disputes arising between users from transactions.

7.1 Limitation of liability

To the maximum extent permitted by applicable law, our aggregate liability for any direct damages arising from your use of the service is limited to the total amount you have paid us in the 12 months preceding the event giving rise to the claim, or EUR 100 (or RON equivalent), whichever is higher. We are not liable for indirect, consequential, special, punitive, or exemplary damages — including lost profits, lost data, lost business opportunities or reputational harm — even if we were advised of the possibility of such damages. Nothing in this clause limits liability for fraud, gross negligence, death, personal injury, or any liability that cannot be excluded under applicable mandatory law.

7.2 Force majeure

Neither party is liable for any failure or delay in performance caused by events beyond reasonable control, including but not limited to: acts of God, war, terrorism, civil unrest, pandemics, government action, internet or power outages, failure of upstream service providers (Hetzner, Anthropic, Stripe, Google, Facebook), or cyber-attacks. The affected party will resume performance as soon as the force majeure event ends.

7a. Reporting illegal content (notice and action)

In accordance with the EU Digital Services Act (Regulation (EU) 2022/2065, "DSA"), any person or entity may notify us of content on our platform they consider to be illegal. To submit a notice, send an email to suport@justsell.ro with the subject line "Illegal content report", including:

  • The exact URL of the listing or message you are reporting
  • A clear explanation of why the content is illegal (referencing applicable Romanian or EU law)
  • Your name and contact details (anonymous notices may be acted upon but cannot be answered)
  • A statement of good faith belief that the information provided is accurate

We acknowledge each notice without undue delay and assess it diligently. We will inform both the notifier and the user whose content is affected of any decision taken, with a statement of reasons. Decisions taken on the basis of automated content moderation are likewise communicated to the affected user.

Internal complaint handling (DSA Art. 20): If you disagree with a moderation decision affecting your content or account (rejection, removal, suspension), you may submit a complaint to the same email address within 6 months. Complaints are reviewed by a person who was not involved in the original decision.

7b. User code of conduct

When using messaging or offer features on the platform, you agree NOT to:

  • Send unsolicited commercial messages, spam, or repeated identical messages
  • Harass, threaten, defame or insult other users
  • Attempt fraudulent transactions, phishing, or impersonation
  • Solicit personal data beyond what is required to complete a transaction
  • Direct buyers off-platform to circumvent platform features (e.g. fees, when introduced)
  • Send links to external sites containing malware or unlawful content

Violations may result in message deletion, account suspension or permanent account termination, at our sole discretion. To report abusive messages, email suport@justsell.ro with the relevant message ID and a brief explanation.

8. Intellectual property

You retain ownership of the photos and content you upload. By using the platform, you grant us a limited, non-exclusive licence to process, display and store your content solely for the purpose of providing the service.

The code, design and JustSell brand belong to us and are protected by intellectual property law.

9. Personal data

We process your personal data in accordance with GDPR Regulation (EU) 2016/679. We collect and use data exclusively for:

  • Account management and authentication
  • Providing AI analysis and listing publication services
  • Account-related communications (notifications, terms updates)

We do not sell your data to third parties. You may request deletion of your account and all associated data by emailing suport@justsell.ro.

10. Suspension and account deletion

10.1 Manual suspension

We may suspend or delete your account at our discretion if you:

  • Violate these terms
  • Publish illegal or fraudulent content
  • Have been inactive for more than 24 months

10.2 Automated suspension based on moderation incidents

To protect the platform and other users, we operate an automated suspension system. Each time a piece of your content (an image upload, listing field, or message) is rejected by automated moderation a moderation incident is recorded on your account. If your account accumulates more than 10 incidents within 7 rolling days, your account is automatically suspended.

The thresholds and time window above are the current values for the Romania market. We may adjust them at any time, in good faith, to balance platform safety with user experience. Any future change applies only to incidents recorded after the change takes effect.

A suspended account cannot create or edit listings, send messages, or sign in to the platform until the suspension is lifted.

How to appeal a suspension: Send an email to suport@justsell.ro within 30 days of suspension. Your appeal is reviewed by a person who was not involved in the original automated decisions. If we find that the suspension was incorrect we will lift it immediately and where appropriate clear the underlying incidents. This satisfies our obligations under Article 20 of Regulation (EU) 2022/2065 (DSA).

10.3 Self-deletion

You may delete your account at any time, instantly and automatically, from Settings → Danger zone or directly via this page. Upon deletion, your account, every listing, every photo, all moderation incidents and any OAuth connection (Google, Facebook) are permanently and immediately removed.

If you are signed in with Facebook and remove the app from your Facebook settings, your data is deleted automatically based on the request received from Facebook.

11. Changes to these terms

We may update these terms periodically. We will notify you by email and in-app banner at least 15 days before any significant change. Continued use of the platform after the effective date constitutes acceptance of the new terms.

12. Dispute resolution

12.1 Direct resolution

Before initiating formal proceedings, please contact us at suport@justsell.ro. We will endeavour to resolve the dispute amicably within 30 days.

12.2 Consumer protection authority (ANPC)

Romanian consumers may submit complaints to the National Authority for Consumer Protection:

12.3 Online Dispute Resolution (ODR)

EU consumers have the right to use the European Commission's Online Dispute Resolution platform: ec.europa.eu/consumers/odr. We are not obliged and not willing to participate in alternative dispute resolution proceedings before a consumer arbitration body unless required by law.

12.4 Governing law and jurisdiction

These terms are governed by Romanian law without regard to its conflict-of-laws principles. EU consumer protection law applies to consumers in their country of residence to the extent it provides higher protection. Any dispute that cannot be resolved amicably will be submitted to the competent courts of Romania, save for mandatory jurisdictional rules protecting consumers under their national law.

13. General provisions

13.1 Severability

If any provision of these terms is held invalid or unenforceable by a court of competent jurisdiction, the remaining provisions remain in full force and effect. The invalid provision will be replaced by a valid one that most closely matches the original economic and legal intent.

13.2 No waiver

Failure to enforce any provision of these terms does not constitute a waiver of that provision or any other.

13.3 Assignment

You may not assign or transfer your rights or obligations under these terms without our prior written consent. We may assign our rights and obligations to an affiliate or in connection with a merger, acquisition or sale of substantially all our assets, with notice to you.

13.4 Entire agreement

These terms, together with the Privacy Policy and Cookie Policy, constitute the entire agreement between you and JustSell and supersede any prior agreement on the same subject matter.

13.5 Language

These terms are made available in Romanian and English. In case of conflict between language versions, the Romanian version prevails for users resident in Romania, and the English version for all others.
